The Law Firm of Lindy Korn — History
The law firm of Lindy Korn came into being after 23 years of legal and life experiences culminating in the "birth" of a plaintiff oriented civil rights practice with an emphasis on preventing and correcting sexual harassment and retaliation.
In 1991, the Civil Rights Act of 1964 was amended to include for the first time in U.S. history—discrimination based on sex—leading the way for protection between males and females, same sex persons and even customers or users (the public) in regards to sexual harassment.
The laws deal with zero tolerance of sexual harassment at work and preventive efforts taken by employers to limit liability as it arises. Management of these risks has lead to many creative solutions, focusing on safe complaint procedures, early reporting, and investigations resulting in corrective actions when liability is found.
This law firm takes a holistic approach to relationships in the workplace and examines the employee's claim and the employers risks on issues such as: family, health, insurance, retention, workplace productivity, and legal liability. Understanding that sexual harassment effects all aspects of a persons life, is central to finding a fair and timely remedy.
Sexual harassment is about power and the abuse of power in the workplace. Retaliation often is found to exist when such a complaint is made at work.
The law firm of Lindy Korn is resolved to listen to clients. We always ask what they want to get out of the legal proceeding being contemplated. The answer guides the client and the lawyer—as a team —towards a satisfactory result. It has been said that when Lindy Korn listens....people talk!
Four Points of the Holistic Approach Followed by The Law Office of Lindy Korn
1. Consultation
Attorney Lindy Korn always asks the client what he/she wants to get out of going forward. Some requests are: an apology, training for an individual supervisor, termination of a management employee, money, a chance to tell his or her side of the story, psychological counseling for the alleged harasser...to name a few.
2. Pattern Identification
Often times, the center of the wrongful termination relates to a power imbalance or private information that one party has about another. Attorney Lindy Korn attempts to discover the patterns and trends of other employees who have been treated similarly, sometimes reflecting repetitive behavior that leads to a hostile environment.
3. Analyzing the Complaint Process
The client and Attorney Lindy Korn examine the company policy, to determine if the complaint process has been fully utilized, and if any violations have occurred on the part of management. What happened when the client first complained?
4. Investigation Evaluation
After complaining, did the employer conduct a prompt investigation? Were the results conveyed in general terms to the complainant? Who conducted the Investigation? What does the company policy state about the Investigation procedure? During the course of the investigation, were both parties put on leave? Were the employees questioned, intimidated or caused to fear for their jobs?
